Trying to help Mother-In-Law over from China for visit. Unsuccessful w/ tourist Visa process, so now going for Green Card. Received Notice of Decision against me, unable to establish my Petitioner wife is daughter of Beneficiary Mother-In-Law. No hospital records. Previous evidence was "Notarial Certificate of Relationship." I have just received new evidence "Notarial Certificate of Birth" from civil authorities - along with affidavit from school teacher - I need to file EOIR-29, I think to call it APPEAL, OR IN THE ALTERNATIVE, MOTION TO RECONSIDER - can anyone provide a "go-by" as to what format my letter should take? Is letter format acceptable or is formal pleading format needed?
Time is of the essence, I have to file within 24 hours or give up and pursue DNA testing....

If names are intercahnged it has to be corrected. It MAY create problems When Name goes for FBI Clearance. Better do it..

Do not do this - please stop playing around with USCIS rules. There are sometimes unfortunate circumstances where folks lose status (e.g., OPT -> H1b) or are kept in dark about their H1B status by employers but for folks who break the law in a way that you are suggesting, I believe they should be punished.

Received the email from Cris I-140 approved today.
I just would like to know how long it should generally take for I-485 approval. Now visa's were current when I file I485. What is the status now do I have to wait for visa's to be current again? Sorry for lack of knowledge GC process takes so long sometimes its good to just forget about it :)

I think if you are out of the country for 1 year u can get 3 yr extension. But you would get counted in the quota though,fresh H1, I think.

My wife is on H4 currently (came into USA on H4). We are planning to apply for her H1 in April. Once it is approved, we are planning to to CANADA for H1 stamping.Her current H4 visa expired in 2006. I-797 is valid till May 2007.
How easy is to get new H1 stamping (from H4) in CANADA?
What issues you face?
She has a US masters Degree?

New numbers are out on H-1B usage and the past week showed a substantial pickup in usage with more than 1700 numbers counted against the cap of 65,000. 36,600 H-1Bs have been counted now. Since you were working all these times, please carry the W2 for 2008 ( for both of you). They may/may not ask for this, but its safe to carry the document
I am currently on H1 but planning to go on H4 due to current economic scenario.
I am planning to go to India due to some family reason and planning to get COS from H1 to H4 in India.
I have my salary slips and my husband has also maintained his status throughout.
Has anyone heard any horror stories about H4 stamping cases getting denied.
What documents they ask for when you go for COS from H1 to H4. Besides salary slips can they ask for my W-2's or they need my husband's W-2's only

I have MS+2 yrs of experience(software engineer). The company i am thinking to join is in Boston.
I am guessing boston is a highly educated town with many young graduates roaming around. Having said that, will this be an issue while we send out an ad for MS+2 yrs as there might be several responses to the ad and refuting all of them would be difficult ?
Please let me know, if I am THINKING CRAZY or this is TRUE. Another option i have is a company in chicago. Not sure where will I be better off as far as GC is concerned.
Also, anybody heard of MONIQUE KORNFELD immigration attorney based out of Newton, Massachussets ??? If so, please let me know about her expertise. I JUST can't find out how many yrs she has been practising immigration.

My wife filed I-539 for changing status from H-4 to F-1 at end of May. We have the receipt and the case is now pending. Is it possible for her to request cancellation of this change of status and continue in H-4 status? If so, does anyone know how to ask USCIS for this?

Dear attorney,
please help me understand my problem.
Through company A , My I 140 has been approved and have my 485 filed too ( i do not have the receipt number or the approval letter for the 140). I am still using the H1 from Company A
Can i move to Company B, on H1 transfer file Ac 21, and have perm and Labor approved through company B and then port the date of company A priority date
Without me having a proof of 140 approval will it be possible to port to the earlier date.
Or should i have company B file labor and 140 as a future employer have 140 approved then port it and move to employer B.
