Hey you are mentioning that you are in EB3 India with a Priority date of AUG 2004. When did you file for the I-485. To my knowledge it was never until this July Fiasco. Can you please explain.

I'll take my family to the congressman's office and the documents that you suggested. We can not sit quiet now!
I met the local office of my Congressman with the following documents to make it easy & simple..
A copy of the Congresswoman Lofgren's letter written to USCIS etc ( download it from IV homepage )
A copy of Today ( July 5th ) Wall Street Journal . This issue has story about this fiasco.
Downloaded news flash from Murthy.com regarding Visa bulletins of 13th June & the screwup bulletin on 2nd July
Above was good enough to convince them regarding the mess & they promised action on their part..
IMPORTANT... I clarified that IT IS A PROCEDURAL ISSUE WITH USCIS
NOT AN IMMIGRATION ISSUE WHERE CONGRESS HAS TO TAKE ACTION
This really made them very comfortable as she said, we keep writing to concerned offices about procedural matters.
I told them that they should ask USCIS to " RECEIVE" aour applications to minimize our finanacial loss and other headache of refiling at a later date
Please note, it is real easy to meet the Congressman as they have local offices may be one mile away from your office or home.
Small towns like mine are great for this effort as compared to big towns. I encourage all of you particularly living in small towns to make this small move, which I am sure can resolve our issue & we will save all the $$$ in refiling & avoid further agony

what i dont get is..why are desis so stuck up abt GC... dont get frustrated...work the system and work with the system!
making statements like Mirage did in the beginning of this thread are pointless!!!
i think its all part of a well thought out conspiracy to:
1.) Keep the chicken in the cage: get those desis into the system and tie them up in some legal/bureaucratic loop for 10-15 yrs.. the taxes and the application fees we desis pay keeps the system running..
2.) These fixes that IV is trumpeting abt..is just chicken feed... nothing big will ever materialize...

Visa number is differnt from A #- which is application number.
Law allows only 140,000 EB visas per year, which are again subject to country quotas,EB categories etc
Every 485 approval uses a Visa number.
So for 485 approval there should be a visa number available.
In last quarter of every year, USCIS can approve 485s irrespective of country limits inorder to use up all visa numbers.
That is what happened in June/July and happening now- Inorder to exhaust remaning 60K visas for yr 2007, USCIS assigned a visa number to pending 485's before approving them.(Tons of approvals coming from NSC and TSC are for cases that had visa number preassigned before July 2nd Visa bulletein revision)

Congressman's liason may be able to help, but to be on the safe side, fork out $350 and dispute the denial in federal district court. It is different from mandamus, it's an agency action which is not in accordance with the law. Court filing may help you to preserve status/EAD/AP.
Can you shed some light on this process? Do "Immigration Litigation" Attorneys be able to help in this?
This person had been posting on Murthy forum and he did get responses from Attorneys that "mandamus" is the way to go.

Bring our issues in front of Ombudsman with the kind of time line we expect and let him take it up with the Govt.
I strongly doubt whether he could help. I am not sure how many people have done like me, but the recent change of de-linking H4 time from H1 was a year long effort by me with all the laws reffered and countered arguments that i provide to ombudsman. He helped in that but the help was routing it to appropriate AG's staff. So with such a deluge of application , he will analysis and make a recommendation that would take as long as this EAD issue will cease to be an issue and that would take another year for USCIS to implement.

We (5 People) work for IBM company, SFO, today we went personally to the congress men and we submit the letter which is provided in this forum and after that we called state senator office and we explained about our problem. We faxed and email the letter to the senator office, staff had taken my contact details and they told me that they will inform the solution in 2days.

I have been on a monthly contributions program that contributes every month to IV since JAN 2007. If this effort requires the money now, is there a way I can divert the monthly to this effort for the next 3 months. Or should I cancel my monthly contribution and just donate a lump sum for this effort?

I would say to follow your attorney's advice though I don't think of any issues with going for premium processing as you are with the same employer. My friend has recently filed I-140 under regular processing and got approval within 2 1/2 months. Just make sure if your attorney submitted porting request while filing new I-140 under EB2. All the best.

My friend, "USA point of view is multinational executives can potentially create jobs", but the reality is the other way round. They are here to to make the transition happen from Onshore to Offshore. I have complete knowledge on how this EB1 thing works , as I was one of them once upon a time before taking up my current job.
