Some members quoted that they hold a second H-1B. Because these second H-1Bs do not fall under any quota, this is a USCIS given gift for us, considering how slowly they process our applications.

A friend of mine lost his I797. His lawyer asked him to apply for duplicate.He got the duplicate after few months. I don't know the exact procedure was.

Currently, I am working with software firm (not a contract work). My wife is re applying for H4 visa. she applied for h4 last year in Feb, i used to work with contracting firm then and refused under 214b(immigration intent). This time we are applying through attorney. Attorney have sent email thrice to Islamabad consulatein Pakistan stating that denial under 214(b) for H4 is not valid reason.
But no response from them.
However my wife is applying again and taking letter with her from attorney stating that reason was invliad.
I am wondering
1- Do we need to highlight the previous denial so much as she is applying on new h1B now
2- in any case, can they revoke and cancel my petition as if they do not find any valid reason to reject again.
I am looking forward to hear from you

I have a question; my girlfriend came to the US with a tourist visa in 2002 (now her visa is expired), so now I guess she is an ilegal alien, my question is: Is there anyway she can become a legal resident?

Now that the I-485 gates have been opened, I would like to know what will happen to my spouse's H1B application pending before USCIS? Since I am planning on filing for I-485 for my spouse as well, will the H1B process make a difference? Or will the H1B approval cause any issues to the I-485 application?

I don't think so. One of my friend is in same situation. I feel 485 is filed after H1b so every thing is fine. But on which boat they need to travel is the question? you can't use H1 if you use EAD?

1)I graduated in masters in december 2008.Iam working on OPT extension which expires on june2,2011.Iam thinking to apply for H1.Accordint to current situation,can i submit H1 application after october 2010 also? as CAP will be still open for masters quota(hoping)?can i put start date immediate after my opt status expiry date or it will start only on conventional date oct1st of every year?
2) Iam planning to fly India in between mar 2011 -may 2011 for 1month...so if iam approved with H1(if above questions says yes) then i need to go to H1 stamping and when i enter US ...i need to change my status from opt to H1 right at US entry.
3) if iam going in apr/may 2011 when should i start the H1 processing?(it should be before 6months only)

I noticed they have a Calls to Action from Groups and Organization on the home page, When i tried to see if there are any Immigration related issues posted There were many like increasing H2A etc but nothing corresponding to Retrogression or GC waiting faced by thousands of immigrants.
There are 100s of bills waiting for Co-sponsors published on this website.
I felt we should do post about the issues faced by Thousands of Legal immigrants who are struck in retrogression or Per country limit.
This may be a good place to put as a number of representatives may view it and it is a good way for us to let the people know of the issues.
Any thoughts........
