I read here that King said that everyon on EAD and AP is getting a free ride even thought here green card might get rejected. What does he mean by that. I tahught every process goes thorugha security check. such as I 140, H1b, AP and even EAD.

I keep reading people getting emails from USCIS. I don't remember providing my lawyer with my email address? When/where do you provide the email address? Tx

I think there will not much visa numbers unused. If at all, it may be in few hundreds. We are thinking our point of view, even wasting one visa number is ridiculus based on number peoples are waiting. However, the INA states that every year "not more than 140,000 EB visas should be issued".It sets only upper limit not the lower limit. Therefore DOS has be more vigilant in not exceding 140K. By doing so, there may be a few wastage of numbers. If they issue 120K instead of 140K, it is not the violation of law. Insted if they issue 141K it is vialotion of law.

However, if the wastage is more than few hundreds it is definitly not acceptable.

2 tier filing as of now does not allow EAD. it is only to pre adjudicate cases for i-485. Also, it opens a whole bunch of other problems. please read related (old) thread to it on this site.

If as part of 2 tier filing, EAD is allowed, i am all for it. So, we are only asking to get EAD/I-485 filing as soon as I-140 is approved.

I got a email notification from my attorney just now that my I-140 is approved with priority date ported from EB3. Not sure whether I should wait few weeks before initiating interfiling process.

Almost all companies, in every field (engg, medicine, nursing, research..) hire people through contracting agencies. Most of the companies these days hire only US citizens or GC or EAD and try best not to hire H1b and if you look at their employees, it is rare to find 50% or more h1b holders.

On the contrary, outsourcing companies may have majority of their workers coming here on L1 or H1b and when such a fgee is imposed, I guess, for the biggies, it is just a small adjustment in their costs of bringing workers which they will adjust in their other expenses.

Overall, I am not sure, how much revenue such a law will generate. Will it generate enough revenue which is being claimed (600 million?)

To me, this kinda speech and trashing Indian companies and outsourcing etc... and showing that they acted on it just looks like it is pure politics to save face during the election year.

I agree 100% too. Just feel so helpless.

After reading all your comments, I reached to a conclusion

We all are being fooled and frusturated by USCIS.

Now the question is, what are we going to do about it, keep complaining and whinning about it, or do something constructive.

Well I believe when we are all so knowledgabel about USCIS efficiency, what do we do next?


Well lets give out a big shout to something big, get some media attention and put pressure on USCIS. Unless we still choose to visit IV to express our frusturations and then logg of this webiste and continue to our daily cores.



Lets just wake up for one more time, and do something big, phone calls, faxes does not give us a public exposure, what we need now is public exposure, I have have been saying this for a while but no one seems to give an important consideration. Right now media attantion is in DC, and we can use that in our own advantage.

Sorry it is not really related to the thread !.

Ths USCIS site says the following ....

"....The current fee schedule will apply to all applications filed under Visa Bulletin No. 107 through August 17, 2007. (The new fee schedule that becomes effective on July 30, 2007, will apply to all other applications filed on or after July 30, 2007)."

Does that mean if I file 485 on Aug1st I have to pay new fees?

Can someone explain what "Temporary Restrain Order" would do if it were successful. It sounds to me that the lawsuit is asking the court to temporarily invalidate the July visa bulletin so that USCIS will be forced to accept the applications. Is this a reasonable understanding? Any lawyers here?
